The initial Complaint against Fundsz by the CFTC has been dismissed by Judge Berger, who deemed it an “impermissible shotgun pleading.” However, this dismissal was based on technicalities rather than the merits of the complaint. The CFTC has been given until September 8th to file an Amended Complaint. On September 7th, the CFTC requested an extension of time due to the passing of Defendant Rene Larralde. The court granted the request, giving the CFTC until October 6th. Although the case hasn’t been dismissed, the previously granted preliminary injunction likely remains in effect. The court has stated that if the CFTC doesn’t file an Amended Complaint, the case will be dismissed.
