That was a quick one.   

Eddy Alexandre is already attempting to evade the bail requirements of his EminiFX bail.   

On the 12th of May, Alexandre was taken into custody and then freed on bail, with strict conditions attached.   

On May 19th, Alexandre’s new attorney appeared in court. The notice of appearance was accompanied by a letter asking for a change in Alexandre’s bail conditions.   

The defense argues that Alexandre was unaware of the CFTC order at the time of his bail hearing.   

Alexandre’s bail conditions, which he wants to change, should not be covered by EminiFX investor funds.  That means Alexandre was living off the $14.7 million he stole from EminiFX, and that was his only source of income.  If he decides to leave the country, Alexandre’s lawyer says he’ll agree to be extradited from Haiti.   

If Mr. Alexandre leaves the United States during this case, he must agree to be extradited back to the United States to face the charges in the complaint.   

Alexandre’s house confinement will continue, but he will no longer be under the watchful eye of a private security firm.   

Before submitting the application, the DOJ was contacted to discuss the proposed change. The letter says “the government opposes this application.”   

Personally, I see the missing EminiFX funds as a major sticking point here. According to Mr. Alexandre, the lost money has not been returned.   

Providing financial disclosures under the terms of Mr. Alexandre’s bail should not jeopardize his right against self-incrimination.   

If Alexandre were to escape, the cryptocurrency he’d have access to would be kept in an undisclosed location. That’s fine.   

No matter whether or not Alexandre agrees to be extradited, I’d have thought that would be enough to put him at risk of escaping justice.   

The court has also released Alexandre despite the missing millions, so that’s a moot point for the time being. Is there much difference in terms of confinement at home with a guard or without?   

Until we see the Department of Justice’s response, we can’t say for sure. This week, I’m expecting it.
